We are gratified that the court gave this issue the long and careful consideration that it deserved. Everyone involved agrees that Judge Hoeveler has been a great judge with a long and distinguished career. For that reason, it was a difficult decision to bring the motion.

Judge Hoeveler presided fairly over this matter for a number of years. However, as Judge Zloch's order states: "It is evident that extra judicial sources may have influenced Judge Hoeveler... Certain statements demonstrate an objective doubt as to Judge Hoeveler's continued impartiality."

We will continue to work cooperatively with the Court in complying with the consent decree and working toward Everglades Restoration.
